Associate Compliance Counsel

As Associate Compliance Counsel, you will: 

Serve as in-house compliance counsel to support our title and escrow operations on a wide variety of matters related to real property law, escrow rules and procedures, and title insurance underwriting. Create, manage, and maintain compliance monitoring programs and periodic testing procedures across these departments, evaluate risks, identify improvements to processes and controls, support the implementation of process changes, and create and maintain appropriate documentation.   

What you may work on: 

  • Work cross-functionally with Operations, Sales, and Client Engagement teams to ensure compliance with applicable rules and laws governing the title insurance and escrow industries.

  • Regularly review and audit the company’s escrow procedures in all relevant states to ensure compliance with applicable state laws and industry best practices. 

  • Assist Senior Regulatory Counsel on third-party compliance reviews and audits including state audits, financial audits and underwriter audits. 

  • Monitor state legislative and regulatory updates pertaining to escrow procedures and partner with Operations to distribute information and implement necessary changes. 

  • Provide support to the title team on an as-needed basis, including responding to title/underwriting questions, preparing title commitments, and advising on underwriting policy.  

  • Make recommendations to improve processes, reduce risks to the business, and improve future audit results.

  • Prepare reports for senior management on the results and performance of the Compliance Program.

  • Serve as a business-savvy, problem-solver for novel and extraordinary real estate issues and closing problems that are escalated to the legal team.

  • Provide training to Sales, Ops, Client Engagement, and other teams on topics including RESPA compliance, wire fraud, and common title risks.

  • Serve as primary contact for potential agency claims, including assessing risk, conducting investigations, and advising senior legal counsel on the scope of risk and recommended course of action.

  • Assist General Counsel and senior legal team members on special projects requiring legal research and analysis.

  • Oversee the company’s security awareness training initiatives.

What we are looking for in you: 

  • Law degree from an accredited law school.

  • Admitted to practice law in at least one state and in good standing.

  • 2 to 4 years of experience acting as a closing attorney or in-house counsel for a title insurance or escrow company, preferably with experience in a compliance role or as claims counsel.

  • Excellent understanding of fundamental concepts, practices, and procedures of real estate law, title, and settlement process, including Good Funds laws, RESPA, and other relevant laws and regulations.

  • General knowledge of Federal and State regulations related to real estate title insurance and settlement services.

  • General understanding of underwriting real estate transactions for the issuance of title insurance policies

  • Exceptional legal research and analysis skills with the ability to research regulations across all jurisdictions and communicate them effectively across diverse stakeholders.

  • Ability to collaborate and act decisively, independent thinker who will add value to the legal team and company as a whole.

  • Detail-oriented with the ability to produce quality work products by scheduled deadlines.

  • Must be willing to learn new things and take on new responsibilities.
